1. Agreement to Terms
By accessing or using FloodWatch ("Service"), operated by FloodWatch Ltd (Company No. 17031025, registered in England & Wales, registered office: 3rd Floor, 86-90 Paul Street, London, EC2A 4NE), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
The Service is intended for business use. By subscribing to a paid plan, you confirm that you are acting in the course of your business, trade, or profession and not as a consumer.
2. Description of Service
FloodWatch is a visibility and aggregation tool that displays flood warnings and river level data from the Environment Agency, Natural Resources Wales (NRW), and Scottish Environment Protection Agency (SEPA). The Service provides:
- Portfolio mapping of your monitored sites
- Aggregated flood warning display
- River level readings and trends
- AI-generated situational briefs
3. Important Disclaimers
FLOODWATCH IS NOT A FLOOD FORECASTING SERVICE.
- We display current warnings from official sources, not predictions.
- The Service is for situational awareness only, not safety decisions.
- Always refer to Environment Agency, NRW, or SEPA official guidance.
- In emergencies, call 999 immediately. FloodWatch is not monitored 24/7 and is not a substitute for official emergency alert systems.
- FloodWatch does not constitute professional advice. Seek independent professional advice before making property, insurance, planning, or investment decisions.
- FloodWatch reports are not a substitute for formal environmental searches required in property transactions.
Data Accuracy
Flood warning and river level data is sourced from the Environment Agency, Natural Resources Wales, and SEPA via their public APIs. FloodWatch does not verify, modify, or guarantee the accuracy, completeness, or timeliness of this data. Data may be delayed, incomplete, or contain errors at source. FloodWatch shall not be liable for any loss arising from data inaccuracies or delays.
AI-Generated Content
AI-generated briefs and summaries are produced by large language models and may contain inaccuracies, omissions, or errors. They are provided as a convenience summary and should not be relied upon as the sole source of information for decision-making.
4. User Accounts
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the Service
- Resell or redistribute the Service without permission
- Use automated means to access the Service excessively
6. Subscription and Payment
- Paid plans are billed monthly or annually as selected
- Prices are in GBP and exclude VAT where applicable
- You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period and you retain access until then
- Refunds are provided at our discretion
- We may change prices with 30 days' notice
7. Data and Content
Your Data: You retain ownership of data you create and upload, including site names, site locations, user accounts, organisation details, notes, tags, and configuration preferences. You grant us a limited licence to use this data solely to provide and improve the Service.
Flood & River Data: Flood warnings, river levels, and related environmental data displayed in the Service is sourced from the Environment Agency, NRW, and SEPA under the Open Government Licence v3.0. This data is public sector information and is not owned by you or by FloodWatch. We are not responsible for the accuracy, completeness, or timeliness of this data.
Data Export: You may export your site data at any time via the dashboard export feature. Upon account termination, you will have 30 days to export your data before it is permanently deleted from our systems.
8. Cookies and Tracking
We use essential cookies for authentication and site functionality. With your consent, we also use analytics cookies to understand how visitors use our Service. You can manage your cookie preferences at any time via the cookie banner or by contacting us. For full details, see our Cookie Policy.
9. Intellectual Property
The Service, including its design, features, and content (excluding third-party data), is owned by FloodWatch. You may not copy, modify, or create derivative works without permission.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the 12 months before the claim
- We are not liable for any loss or damage caused by reliance on flood data
- We are not liable for the accuracy, timeliness, or completeness of third-party data from the Environment Agency, NRW, or SEPA
- We are not liable for any decisions made based on data or AI-generated content displayed in FloodWatch
- We are not liable for losses arising from service unavailability, including upstream data source outages
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may suspend the Service for maintenance, updates, or circumstances beyond our control.
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, utility or telecommunications failures, cyber attacks, and outages or changes to upstream data sources including the Environment Agency, Natural Resources Wales, and SEPA APIs. FloodWatch depends on these third-party data feeds and cannot guarantee service continuity if they become unavailable or are modified.
13. Termination
We may terminate or suspend your account immediately for Terms violations. We will provide 30 days' notice for termination without cause. Upon termination, your right to use the Service ceases. You will have 30 days to export your data, after which it will be permanently deleted from our systems.
14. Changes to Terms
We may modify these Terms at any time. We'll provide notice of material changes. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales.
